DISTANCE SALES CONTRACT

Please read this Distance Sales Contract carefully before completing checkout purchases on our website. By confirming your purchase, you unconditionally agree to be bound by all the terms and conditions set forth herein.

The subject of this Contract is to define the rights and obligations of the parties in accordance with the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts in Turkey regarding the sale, digital delivery, and payment of the Mistikist Premium subscription plan or digital activation code purchased electronically by the Buyer on the Seller's website (mistikist.com). The Mistikist mobile application and website infrastructure are operated collectively on high-availability global cloud environments (Google Cloud Platform - GCP, Google Firebase, Amazon Web Services - AWS, Microsoft Azure) and secure billing gateways (Stripe, Aköde/Tosla).

3. Specifications, Pricing, and Digital Performance

• Service Description: Mistikist Premium subscription (including Monthly, Annual, or Lifetime plans) which grants ad-free usage, access to premium sound/light frequency streams, custom playlist generation, and Mistik AI cognitive guidance features.
• Pricing: The final checkout pricing in USD, EUR, TRY, or other currency shown to and approved by the Buyer. All local taxes are included in the price.
• Payment Method: Securely collected through credit or debit card via our secure checkout gateway (Stripe for international transactions under Mistikist LTD; Aköde/Tosla for TRY transactions under Shellix Bilişim A.Ş.).
• Method of Delivery: Upon successful payment completion, the digital activation credentials and setup instructions are instantly generated and sent to the Buyer's registered email address. The Buyer can active the premium access code directly within the Mistikist mobile application settings.

4. Right of Withdrawal & Refund Policy

IMPORTANT LEGAL DISCLOSURE:

In accordance with Article 15(1)(g) of the Regulation on Distance Contracts in Turkey, the right of withdrawal cannot be exercised for contracts regarding services performed instantly in electronic environments or intangible goods delivered instantly to consumers. Therefore, premium digital licenses and activation codes are legally excluded from the standard statutory right of withdrawal once delivery has occurred.

The Buyer acknowledges and accepts the following safety disclaimers before initiating frequency playback:

6. General Terms

• The Buyer warrants that all billing details, email addresses, and country coordinates submitted during checkout are fully accurate.
• The Seller is responsible for the instant and technically functional delivery of the digital code to the Buyer's email. The Seller is not responsible for delivery delays caused by Buyer's spam filters, email inbox saturation, or local network blockages.

7. Governing Law & Jurisdiction

This Contract shall be governed by, and construed in accordance with, the laws of the Republic of Turkey. For any legal disputes arising out of the performance or interpretation of this Contract, the parties agree that the **Courts and Execution Offices of Muğla, Turkey** shall have exclusive jurisdiction.
