Terms & Conditions of Service

Welcome to Mistikist. By downloading, accessing, or using the Mistikist mobile application (iOS & Android), the website (mistikist.com), and associated digital services, you unconditionally agree to be bound by these Terms and Conditions ("Agreement"). If you do not agree to all terms herein, please do not use Mistikist.

1. Operating Corporate Entities & Parties

This Agreement constitutes a legally binding contract between you ("User") and the corporate group operating Mistikist ("we", "us", or the "Group"):

2. Digital Services & Limited License Grant

Mistikist provides auditory brainwave entrainment (binaural beats, isochronic tones), visual sensory synchronization (3D tunnel shaders, kaleidoscopic fractals, flickering frequencies), and artificial intelligence-driven personalized sessions (Mistik AI) designed to promote relaxation, focus, deep sleep, and cognitive calm.

Subject to your continuous compliance with this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable, and non-sublicensable license to use Mistikist solely for personal, non-commercial mental wellness support.

5. Driving & Heavy Machinery Absolute Prohibition

Mistikist audio and visual sessions directly influence conscious brainwave frequencies and sensory processing. You are strictly prohibited from using Mistikist while driving a motor vehicle, operating heavy machinery, cycling, piloting aircraft, or engaging in any activity where divided attention could lead to injury, loss of life, or property damage. The user assumes 100% liability for any violation of this safety rule.

6. Subscription Billing, Free Trials, and In-App Purchases

Mistikist offers auto-renewing subscriptions (Monthly and Annual memberships) as well as Lifetime access:

• Trial Periods & Promotional Offers (30-Day Trial): Premium subscriptions may be offered with trial or introductory periods (such as our 30-day trial membership). If you do not cancel at least 24 hours prior to the trial expiration, your account will automatically be billed the standard periodic subscription fee for your selected tier.
• Apple App Store In-App Purchases: Subscriptions initiated on iOS devices are billed directly through your Apple ID account and are governed by Apple Media Services Terms. Renewal occurs automatically unless turned off at least 24 hours before the end of the current billing cycle in your iOS Settings > Apple ID > Subscriptions.
• Google Play Store Billing: Subscriptions initiated on Android devices are billed directly through your Google Play account and managed in Google Play Store > Subscriptions.
• Web Checkout & Stripe Billing: Subscriptions purchased directly on mistikist.com are securely processed by Stripe under Mistikist LTD. Automatic renewal occurs at each billing cycle. You may cancel at any time via your account portal or by emailing [email protected].
• Refund Terms: Digital content delivered via immediate app access is considered consumed upon provisioning. App Store refunds must be requested through Apple (reportaproblem.apple.com); Google Play refunds through Google Play Support.

7. Intellectual Property & Anti-Piracy Protections

All software source code, shaders, neural frequency synthesis algorithms, bilateral audio tracks, fractal visuals, artwork, trademarks (including "Mistikist", "Mistik AI", and "Mind Programming"), and domain names are the exclusive intellectual property of Shellix Bilişim A.Ş. and Mistikist LTD.

You agree not to modify, reverse-engineer, decompile, extract, rip audio files, record visual shaders, scrape, or distribute any content from Mistikist for commercial or unauthorized derivative purposes.

8. User Accounts & Account Deletion

You are responsible for safeguarding your login credentials. In compliance with Apple and Google Play developer requirements, you can permanently delete your account and all stored personal data at any time directly inside the mobile application by navigating to Profile > Settings > Delete Account.

9. Disclaimer of Warranties & Limitation of Liability

Mistikist is provided on an "as is" and "as available" basis without warranties of any kind. Under no circumstances will Mistikist LTD, Shellix Bilişim A.Ş., or their directors, employees, or affiliates be liable for any indirect, consequential, punitive, or special damages, including adverse health events arising from disregard of the medical and epilepsy warnings herein.

10. Governing Law & Dispute Resolution

For international users outside Turkey, this Agreement is governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of London, United Kingdom. For users residing within the Republic of Turkey, Turkish Law applies, and Muğla Courts and Consumer Arbitration Committees hold jurisdiction.
